Infringement opinion overview:

  • To infringe a patent claim, the subject must have every element recited in the claim or its equivalent.

  • An infringement opinion requires an interpretation of the patent claims, which in turn requires an examination of the USPTO file of the application from which the patent issued and all prior art cited therein.
