  • If patent (novelty) search indicates meaningful patent potential.

  • If commercial value of product justifies the patent application costs.

  • If patent rights improve the odds of securing business financing.

  • If patent rights increase the value of your business.

  • If patent rights provide a commercial competitive edge.

  • If patent (novelty) search shows it is not new.

  • If patent (novelty) search indicates little-to-no meaningful patent potential and actual product commercialization is not assured.

  • If commercial value of product does not justify the patent application costs.

  • If you have a narrow niche market without potential competitors.

Defending patents - usually not a patent-or-not factor

  • A good infringement case (merit and collectible defendant) can be handled on contingency basis to hedge costs.

  • If merit is questionable, you can merely ignore it or settle.

  • If defendant is questionable, it might disappear if you just file the case.

  • Patent advantages usually outweigh premature worries about defending it.
